These Terms and Conditions apply to the use of aquasupplydirect.com.au and purchases made from Aqua Supply Direct.

By accessing our website, creating an account or placing an order, you agree to these Terms and Conditions.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

  1. ONLINE STORE

Our online store is hosted by Shopify, which provides the ecommerce platform through which our products are offered.

You must provide accurate, complete and current information when placing an order. You are responsible for ensuring that your contact, billing and delivery information is correct.

You must not use our website for unlawful, fraudulent or unauthorised purposes.

  1. PRODUCTS AND INFORMATION

We aim to display accurate product descriptions, specifications, images, prices and availability.

Product images are for identification and illustration. Packaging, colours, labels and minor specifications may change without notice where the change does not materially alter the product.

Product specifications, capacity recommendations and warranty information may be based on information supplied by manufacturers or distributors.

  1. PRODUCT SUITABILITY

Customers are responsible for confirming that a product is suitable for their:

• Pool or spa type
• Pool volume and operating conditions
• Surface finish
• Existing pump, filter, chlorinator or automation equipment
• Plumbing size and configuration
• Electrical supply
• Available installation space
• Intended application

Pool-capacity recommendations may vary depending on climate, pool usage, water conditions, operating hours, plumbing and other site-specific factors.

Information provided by Aqua Supply Direct is general product guidance and does not replace an on-site inspection or professional advice where one is required.

  1. INSTALLATION

Installation is not included in the product price unless expressly stated in writing.

Electrical, plumbing, gas, refrigeration and other regulated work must be completed by appropriately licensed tradespeople where required.

Customers must follow all manufacturer instructions, safety requirements and applicable laws.

Incorrect installation, operation, chemical balance, water flow, maintenance or use contrary to manufacturer instructions may cause damage and may affect manufacturer warranty coverage.

This section does not limit any rights under Australian Consumer Law.

  1. PRICES AND GST

All prices displayed on our website are in Australian dollars and include GST unless clearly stated otherwise.

Delivery, freight, installation and other additional charges are not included unless shown at checkout or agreed in writing.

We may correct genuine pricing or data-entry errors before dispatch. If an error affects a paid order, we will contact you and provide the option to proceed at the correct price or receive a refund for the affected product.

  1. RETAIL PRICING

Products are sold at the approved retail prices displayed on our website.

Promotions, discount codes and advertised offers are subject to their stated conditions, availability and expiry dates.

A discount cannot be exchanged for cash or applied retrospectively unless expressly stated.

  1. ORDERS

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges that we received your order. It does not necessarily confirm that the product is available or that the order has been accepted for dispatch.

We may contact you if:

• A product is unavailable
• Supplier lead times have changed
• Additional freight arrangements are required
• Product information or pricing contains a genuine error
• Further information is needed to fulfil the order
• We reasonably suspect fraud or unauthorised payment

If we cannot fulfil a paid order, we will offer an appropriate alternative or refund the affected amount.

  1. AVAILABILITY AND LEAD TIMES

Stock levels and supplier availability may change.

Products marked as low stock, special order, back order or subject to supplier lead time may take longer to supply.

Adding a product to the cart does not reserve stock.

We will contact you if a significant stock issue or delay affects your order.

  1. PAYMENT

Available payment methods are displayed at checkout.

Payment must be authorised before an order is dispatched or made available for collection.

Payments may be processed by Shopify Payments, PayPal or another approved payment provider. Those providers may apply their own terms and privacy practices.

We do not store complete payment-card information on our own systems.

  1. FRAUD PREVENTION

Orders may be reviewed for fraud prevention and payment verification.

We may request reasonable identification or payment verification before fulfilling an order. If verification cannot be completed, the order may be cancelled and refunded.

We will handle personal information according to our Privacy Policy.

  1. SHIPPING AND DELIVERY

We currently deliver within Australia only.

Small eligible products may qualify for standard parcel shipping at the rate displayed at checkout.

Pumps, chlorinators, robotic cleaners and other boxed equipment may require specialised courier delivery.

Filters, heat pumps, pool blankets, blanket rollers, long telepoles and other oversized products may require a freight quotation or store pickup.

Delivery times are estimates and may be affected by stock availability, destination, courier conditions, weather, public holidays and events outside our reasonable control.

  1. STORE PICKUP

Please wait until you receive confirmation that your order is ready before attending.

We may request the order confirmation and photographic identification when an order is collected.

Responsibility for the order passes to the customer or authorised collector when collection is completed, except to the extent otherwise required by law.

  1. ORDER CANCELLATIONS

Contact info@aquasupplydirect.com.au promptly if you need to cancel an order.

Orders may generally be cancelled before dispatch unless the product has already been:

• Specially ordered
• Customised or cut
• Transferred specifically for the order
• Prepared for dispatch
• Collected by a carrier
• Otherwise supplied specifically for the customer

If the order has already been dispatched, the applicable return conditions will apply.

This section does not limit any rights under Australian Consumer Law.

  1. RETURNS AND REFUNDS

Eligible change-of-mind return requests must be made within 14 days of delivery or collection.

Change-of-mind products must be unused, unopened, uninstalled, complete, in original packaging and in resalable condition.

Change-of-mind returns may not be accepted for opened chemicals, custom-cut pool blankets, special orders, installed products, used equipment, clearance products or display models.

These exclusions do not affect rights relating to faulty, unsafe, damaged, incorrectly supplied or incorrectly described products.

  1. AUSTRALIAN CONSUMER LAW

Our products come with guarantees that cannot be excluded under Australian Consumer Law.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and whether the failure is major or minor.

Manufacturer warranties are additional to, and do not replace, Australian Consumer Law rights.

Contact info@aquasupplydirect.com.au if you believe a product does not meet an applicable consumer guarantee.

  1. MANUFACTURER WARRANTIES

Warranty periods and conditions vary between manufacturers and products.

Warranty claims may require:

• Proof of purchase
• Product serial number
• Installation details
• Maintenance records
• Photographs or videos
• Inspection or testing
• Evidence that installation was completed by an appropriately licensed person where required

We may assist with manufacturer warranty claims, but doing so does not limit our obligations as the seller under Australian Consumer Law.

  1. CHEMICAL PRODUCTS

Pool and spa chemicals must be stored, handled and used according to their labels, safety data sheets and manufacturer directions.

Never mix pool chemicals unless the manufacturer expressly directs you to do so.

Keep chemicals away from children, animals, heat, moisture, incompatible substances and ignition sources.

Customers are responsible for confirming that a chemical is appropriate for their pool or spa before use.

Nothing in this section limits liability that cannot lawfully be excluded.

  1. ROBOTIC CLEANERS AND ELECTRICAL EQUIPMENT

Electrical and battery-powered equipment must be charged, stored, operated and maintained according to manufacturer instructions.

Do not use damaged cables, batteries, chargers or power supplies.

Where required, electrical connections and installation must be completed by a licensed electrician.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a product review, photograph or other content, you confirm that:

• The content is based on your genuine experience
• You have the right to submit it
• It does not infringe another person’s rights
• It is not unlawful, misleading, abusive or defamatory

You grant Aqua Supply Direct permission to display the submitted content on our website and marketing channels. We will not alter a review in a way that changes its meaning.

We may remove unlawful, fraudulent, irrelevant or abusive content.

  1. INTELLECTUAL PROPERTY

The content of this website, including its text, design, graphics, branding and original images, is owned by or licensed to Aqua Supply Direct unless otherwise stated.

Manufacturer names, logos and trademarks belong to their respective owners.

Website content may not be copied, reproduced or commercially used without permission, except as permitted by law.

  1. THIRD-PARTY LINKS

Our website may contain links to manufacturers, payment providers, delivery companies or other third parties.

We are not responsible for third-party websites or services outside our control. Customers should review the terms and privacy policies of those providers.

  1. PROHIBITED USES

• Attempt to gain unauthorised access to the website or another user’s account
• Introduce viruses, malicious code or harmful technology

Personal information is handled according to our Privacy Policy and applicable privacy laws.

By using our website or placing an order, you acknowledge that your information may be processed by Shopify, payment providers, carriers and service providers where reasonably necessary to operate the store and fulfil orders.

  1. CHANGES TO THESE TERMS

We may update these Terms and Conditions when our products, services, systems or legal obligations change.

Updated terms will be published on this page with a revised “last updated” date.

Changes do not retrospectively remove rights that have already arisen under an existing order.

  1. SEVERABILITY

If part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

  1. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the courts and tribunals having jurisdiction in Victoria, subject to any rights a consumer may have to bring a claim elsewhere under applicable law.
